FICA Line of Duty Injury Reimbursement Update (September 22,2008)
We are informed by the City's Office of Labor Relations that the City of New York has received payment from the IRS in settlement of the City's FICA reimbursement lawsuit to recover FICA taxes paid for periods of authorized Line of Duty injury leave for six (6) months or less from1989 through 2005.The Office of Payroll Administration ("OPA") must now issue checks to eligible members of the service, who timely submitted consent forms during the applicable filing period. The OPA estimates that this process will take approximately 4-6 weeks.
We are informed further that the OPA's website http://www.nyc.gov/html/opa/html/home/home.shtml will be updated this weekend with additional details regarding a tentative payment schedule. Members with questions can also call the OPA at (212) 669-2333.
RETROACTIVE CHECKS FOR RETIRED MEMBERS: (September 19, 2008)
The LBA has been informed that the Retroactive checks related to the Lieutenants Re-Opener Agreement for retired lieutenants, can be picked up at the Payroll Section at One Police Plaza, Room 1018, Monday through Friday between 0800 and 1630 hours.
The Retro Checks will be retained at the Payroll Section for approximately 30-45 days, commencing from September 19th, and then they will be mailed to the members’ last address on record with the Department.
Prior to retrieving the check, members should call the Payroll Section at 646-610-6160 to ascertain or confirm that a Retro Check is at the location. To pick up the Retro Check in person you must bring your I.D. card.
If you wish to have your Retro Check mailed to you, or have someone pick it up for you, a letter must be mailed, faxed, or presented by the person retrieving the check, containing the following information: Members full name, Tax#, last command assigned to, date of retirement, current address, and name of person picking up the check if applicable. The Fax# at the Payroll Section is 646-610-5846.
RE-OPENER AGREEMENT UPDATE: (September 6, 2008)
L.B.A. CONTRACT REOPENER ISSUES: On the September 5th payroll, the Department will pay to those eligible Lieutenants who are at top pay the 3.35% reopener adjustment and retroactive monies on base earnings to 10/08/06. This 3.35% increase will benefit everyone, when they reach their third anniversary in rank. However, as the unions settle their Reopener Agreements, it is apparent that a number of salary issues have developed that adversely affect members of the L.B.A.
Lieutenants currently not at top salary are being adversely affected by the new S.B.A. salary structure. A top pay Sergeant as of 06/01/07 earns a base maximum of $87,186; when the steps for a newly promoted Lieutenant are: $84,156; $85,539; $86,337 and $96,229. Due to the three months difference in starting dates of the contracts, (the S.B.A. being June 1st and the L.B.A. being September 1st ), the problem reoccurs every year. Those Lieutenants in Steps 1 through Step 3 will have a base salary lower than a top pay Sergeant.
Another group of Lieutenants who are adversely affected are those Lieutenants that were promoted to S/A or C.D.S. from 11/03 through the present and were at top Lieutenants salary prior to promotion. These tenured Lieutenants are now making less than a top pay Lieutenant’s adjusted salary. Also, Lieutenants currently not at top pay who receive a promotion to S.A. /C.D.S will have a lower salary than a top salary Lieutenant.
The L.B.A. was the first to address these issues. On July 10th, Tom Sullivan met with Deputy Commissioners Beirne and Cohen of the Office of Labor Relations and brought these problems to light giving the Department time to research and correct these issues that exist in all ranks. On August 21st, a written Step 3 grievance was filed in the Office of Labor Relations. The remedy the L.B.A. is seeking is that those adversely affected Lieutenants be placed in a pay step that reflects an increase in salary commensurate with promotion.
The very core of Civil Service is when you take a test and get promoted, you will get a raise. We are confident we will be able to fix these issues, but we ask for your patience and support. I was informed that no one will jump pay steps by Sept. 5th, it will take several additional months to correct the problem. We will keep you informed of the progress of our grievance.
IMPORTANT PAYDATES:
September 5 - payment of 3.35% reopener increase on base and retroactive money to eligible members
September 19 - payment of 4% contractual increase (eff. 9/1/08) to all steps in pay scale
October 17 - payment of contractual increase to longevity $1,000 annual increase (approx. $38 per check)
October 31 - payment of reopener adjustment on holiday pay retroactive to 10/08/06

ANABOLIC STEROID AND HUMAN GROWTH HORMONE USE
A memo has been issued by the Chief of Personnel regarding the proliferation of anabolic steroids and human growth hormones. (Finest message dated 3/26/2008)
LBA members should read this Personnel Bureau Memo in its entirety.
This memo refers to the physical and professional dangers inherent in abusing anabolic steroids and HGH.
It goes on to state that there are some legitimate medical uses for anabolic steroids,and that synthetic HGH is only available by prescription.
Bodybuilding and/or body enhancement are not legitimate medical uses of anabolic steroids and related substances.
If dosages of these substances are prescribed by a physician for a member of the service and he/she is tested for drugs by the Department, the member will be required to provide the Department with information sufficient to determine if the prescription was written for a legitimate medical condition.
It is the Drug Enforcement Agency’s and the NYPD’s position that obtaining any controlled substance or a prescription for a controlled substance without a bona fide doctor/patient relationship is illegal and subjects the member to disciplinary action. Completing a questionnaire that is simply reviewed by a physician hired by, or working on behalf of, an Internet pharmacy does not establish a legitimate doctor/patient relationship.
Therefore, any member of the service found to be abusing anabolic steroids/HGH will be subject to disciplinary action.
Again, we suggest that members be aware of this memo and read it in its entirety!

Pension Loan Processing Blackout Dates for Calendar Year 2008 (Feb 16, 2008)
Pension Loans will not be processed on the following dates due to implementation of a new computer system. This will not affect a member getting their loan in a timely manner.
It is requested that members not visit the Police Pension fund on the following dates for purposes of submitting paperwork for a Pension Loan. Should a member appear at the Police Pension Fund, 233 Broadway 19th Floor, on these dates, the loan application will be taken but not processed until the next business day.

The Lieutenants Benevolent Association, in conjunction with the Superior Officers Council (SOC), has introduced a new optical procedure through Davis Vision.
On September 1, 2007, all active lieutenants were mailed the new program information and identification cards.
If you have not received this information, call the SOC at 212-964-7500, to verify your address and to provide other information, if required.
Active members will no longer be required to obtain a voucher from the SOC prior to receiving benefits. All other vision care plan benefits will remain the same.

Negotiate a City of New York
Savings Incentive Plan:
A $300 Contribution will be made to
the Plan by the City Annually
Effective July 31, 2007, the City will make a contribution of $300
per year to the 401(a) Savings Incentive Plan (a supplemental Plan to
the 457 Deferred Compensation Plan) on behalf of each active LBA
employee in the bargaining unit who is a member of the 457 Plan. The
contribution is contingent on a 1% deferral to the 457 Plan.
The employer contribution, the first of its kind, is an incentive for
employees to save more for retirement by making contributions to the
457 Plan.
City contributions to the Savings Incentive Plan will not decrease the
annual maximum contribution amount available to participants in the
457 Plan: $15,000 per year currently ($20,000 if the participant is 50
or older.)
Contributions to the Savings Incentive Plan will be immediately vested
and available to the participant upon termination from employment. If
